When to go to trial?

There are many factors to consider in taking a case to trial- In doing our job, the offices of Lewisville Attorney Lars Isaacson take a proactive approach to criminal defense- that is, aggressively pursuing the case at the beginning and trying to opitimize positive choices for the client.

There are three parts to any criminal case. First, the pre-charge phase. Under Texas law, once a person is arrested, they are generally entitled to a reasonable bond. Once bond has been secured (or a reduction in bond to allow the accused to be released), then the District Attorney's office will consider whether to indict or charge a crime. This may be an opportunity to convince the DA to drop the case, or work out an agreement to a lesser charge.

Second, once a person has been charged, their case is assigned to a court- district court if its a felony, county criminal court if its a misdemeanor, and federal district court if its a federal charge. Then, a discussion begins with the prosecution as to a possible resolution of the case. At this stage (and at every stage), the offices of Denton Criminal Attorney Lars Isaacson attempt to gather all information and interview all witnesses to get a clear picture of the states' evidence. Often, motions will be filed to gather or suppress evidence.

 

 

If a case cannot be resolved, then it wil be set for trial. In Texas state courts, the defendant has the right to try the case to a jury, and to select either the judge or a jury to assess punishments.

 

Whether or not to go to trial is a decision that a client must make with as much information as possible.
